











THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS YOUR IDENTIFIABLE HEALTH INFORMATION. PLEASE REVIEW IT CAREFULLY.
CryoGam Colorado's Commitment to Your Privacy
Our organization is dedicated to maintaining the privacy of your identifiable health information. We are required by law to maintain the confidentiality of health information that identifies you, called Protected Health Information (PHI). We are also required by law to provide you with this notice of our legal duties and privacy practices concerning your PHI. By law, we must follow the terms of the notice of privacy practices that we have in effect at the time.
The terms of this notice apply to all records containing your PHI that are created or retained by our organization. We reserve the right to revise or amend this notice. Any revision or amendment to this notice will be effective for all of your records that our organization has created or maintained in the past, and for any of your records we may create or maintain in the future. Our organization will post a copy of our current notice in our office in a prominent location and on our website.
Uses and Disclosure of Health Information
CryoGam Colorado, LLC uses and discloses your protected health information for treatment, payment and health care operations. The following are examples of when our office may use or disclose your PHI without your consent or authorization:
- Treatment: CryoGam Colorado, LLC may disclose your PHI to physicians, nurses, and other health care personnel/professionals who provide you with health care services or are involved in your care. For example, we can provide your physician with your laboratory test results.
- Payment: CryoGam Colorado, LLC may use and disclose your PHI in order to bill and collect payment for the services you may receive from us. For example, we may disclose your diagnosis or other information about your health to your insurance provider to obtain payment for the services we provide.
- Health Care Operations: CryoGam Colorado, LLC may use and disclose your PHI to operate our business. For example, your PHI may be reviewed as part of our quality improvement program. We may also contact you regarding appointments or other health related services.
Other Uses and Disclosure of PHI
CryoGam Colorado, LLC may also use or disclose your PHI without your consent or authorization, in compliance with guidelines outlined by law, for the following purposes:
- Disclosure required by law, judicial/administrative proceeding, or legal enforcement: CryoGam Colorado, LLC will disclose PHI when a law requires that we report information to government agencies, or law enforcement personnel in response to a medical emergency.
- Public Health: CryoGam Colorado, LLC must report certain PHI about various diseases, such as infectious disease reports.
- Health Oversight: CryoGam Colorado, LLC is required to provide PHI to assist the government when it conducts an audit, investigation, or inspection of a health care provider or organization.
- Government Functions: In certain situations, CryoGam Colorado, LLC may disclose PHI of military personnel and veterans. Additionally, we may disclose PHI for national security purposes, such as a national intelligence operation.
Right to Provide Authorization for Other Uses and Disclosures
CryoGam Colorado, LLC will obtain your written authorization for uses and disclosures that are not identified by this notice or permitted by applicable law. Any authorization you provide to us regarding the use and disclosure of your PHI may be revoked at any time in writing. After you revoke your authorization, we will no longer use or disclose your PHI for the reasons described in the authorization.
Your Rights Regarding Protected Health Information Subject to limitation outlined by law, you have the following rights regarding the PHI that we maintain about you:
- Right to Request Confidential Communication. You have the right to request that CryoGam Colorado, LLC communicate with you about your health and related issues in a particular manner and/or at a certain location. You must submit a written request for confidential communication to CryoGam Colorado, LLC specifying the requested method of contact and/or the location where you wish to be contacted.
- Right to Request Restrictions. You have the right to request a restriction on certain uses or disclosure of your PHI. You must submit a written request for restrictions to CryoGam Colorado, LLC. CryoGam Colorado, LLC is not obligated to agree to requested restrictions.
- Right to Inspect and Obtain Copies of your PHI. Unless prohibited by state or federal law, you have the right to inspect and obtain a copy of your PHI. You must submit a written request to CryoGam Colorado, LLC to obtain a copy. Our organization may charge a fee for the costs of copying, mailing, labor, and supplies associated with your request.
- Right to Correct or Update your PHI. If you believe that your PHI contains a mistake, you may submit a written request for information correction to CryoGam Colorado, LLC. We will respond to your request within 60 days. If your request is denied, we will provide an explanation of the reasoning and give you an opportunity to appeal.
- Right to Accounting of Disclosure. You have the right to request an "accounting of disclosures." An "accounting of disclosures" is a list of certain disclosures our organization has made of your PHI. You must submit a written request to CryoGam Colorado, LLC in order to obtain an accounting of disclosures.
- Right to File a Complaint. If you believe your privacy rights have been violated, you may file a complaint by contacting Jenell Cheever, Privacy Officer with CryoGam Colorado, LLC at 970-667-9901 or the Secretary of the Department of Health and Human Services. No individual will be retaliated against for filing a complaint.
